Do's and Dont's
Proprietary rights of members / residents are limited to building line and boundary wall for apartments and SU/SD houses respectively.
Ownership of all open spaces and other used / unused areas excluding those mentioned in Para 2 ante will continue to rest with Housing Directorate which reserves the right to use such spaces/ areas in any manner which may include beside others, any construction, commercial ventures and modification / alteration in Master / Layout / Landscape Plans and Guide Maps etc whenever deemed appropriate by the Directorate and such actions of the Directorate shall not be challenged / objected by any member / resident at any forum whatsoever, so long as they are not inconsistent with their easement as mentioned in Easement act.
Authorized alterations in the inner design of the respective residential unit within its building line are permissible to the members / resident subject to prior written approval from the Directorate and fulfillment of allied formalities in accordance with the policy on the matter. However, any outside changes / alterations in the façade of the house / apartment are strictly prohibited.
Any encroachment / unauthorized construction shall be liable to demolition by authorities at the risk and cost of member / resident along with imposition of penalty which shall be at the discretion of the Housing Directorate.
The House / Apartment or its occupation or possession, shall not be sold, mortgaged, transferred, rented out or handed over to anyone whosever in any manner whatsoever except after having obtained prior written permission / NOC from Housing Directorate in accordance with the rules and procedures on the subject as laid down by the Directorate.
Transfer/ sale on Power of Attorney (POA) is not allowed / recognized by Housing Directorate. However, in case any allottee officer or buyer is living abroad, he / she has to process signing of Housing Directorate’s sales / transfer proforma through concerned Embassy / Consulate General of Pakistan duly verified by that office along with photo session while signing the proforma. In such case his/ her Power of Attorney will be required to appear physically to represent him/ her for all further transfer formalities in the concerned Housing Directorate office / MEO office etc
The Housing Directorate reserves the right to grant or refuse permission for transfer / sale / renting out of house/ apartment in AOHS. All rent agreements must be registered with Assistant Director Housing / Deputy Assistant Director Housing (Askari Colonies). Necessary Security Clearance must be obtained before occupation.
The house/ apartment including garage shall be used only for residential purpose. All political, sectarian, commercial and other undesirable / unlawful activities including cyber-crimes in AOHS by members(s) / resident(s) can attract penalties including cancellation of membership and prompt vacation, without any exception, by the Directorate, provided the attending member has been served, in advance, with the show cause notice at his known address and his reply in that regard is found either unsatisfactory or not received within the prescribed period of time.
All residents/ members are required to abide by the rules/ instructions by Housing Directorate or Askari Colonies Management (ACM) and timely clearance of monthly subscriptions.
The disputes arising between the Directorate and members(s) / residents(s) and other users of property in AOHS shall be referred to the Director General Housing Directorate for Arbitration and to Governing Body for appeals subsequent to Arbitration. Any litigation/ writ in the ’Court of Law’ in cases of disputes, without a prior recourse to Arbitration in accordance with this clause or any media coverage (electronic, print and social media) of dispute/ issue or agitations/ processions/ sit-ins etc shall make an allottee/ member/ tenant and user of property in AOHS liable to cancellation of allotment/ membership and tenancy etc, as may be applicable.
Important Byelaws are enclosed with allotment letter and the Housing Directorate brochure.
Housing Directorate/ Governing Body reserves the right to take necessary action i.e. cancellation of allotment/ membership/ tenancy, disconnection of services etc against the allottee, transferee, owner or user of property who violates any of the Regulations/ Terms & Conditions of AOHS, including any delay in/ refusal to clear colony subscriptions. authorities / Housing Directorate.
